But if elements of white Australia have gone into shock, aborigine organizations don't appear to believe the Mabo case hands them an obvious lever to redress centuries of oppression. "The thing about Mabo is that it has very little affect on the vast majority of aboriginal people because the whole concept of the court's ruling was that native title only applies to people who can show uninterrupted occupation of land and that they still live in a traditional way," Paul Behrendt, director of the Aboriginal Research and Resources Centre at the University of New South Wales, said in an interview. "Most aboriginal people have been forcibly removed from their land and more aborigines live in the suburbs of Sydney and Melbourne than anywhere." This point has been taken up by the Aboriginal and Torres Strait Islander Commission, a body through which the federal government channels most of its Sl-bil-lion-a-ycar assistance to aborigines. The landmark judgment has given the 300,000 Australian aborigines a legal footing that might begin to take them out of the cultural, political and social limbo in which they have lived since the explorers decided the island continent was "terra uninhabited land containing only people whose culture they did not understand and, therefore, chose to ignore. It Is with great regret, and yet rejoicing, that we announce to his many friends the death of Robert F. Legget at the age of eighty-nine years, at the Riverside Hospital, Ottawa on Sunday April 17, 1994. For fifty-three years he was the devoted husband of his wife Mary who died in 1 984. He is survived by his son David and his wife Carole, grandson Duncan and grand-daughter Elizabeth, all of Toronto; by his sister Lucy and her husband Ernest of Lancaster, England; and by nephews and nieces in Canada, U.S.A., Scotland and England. A Native of Liverpool (of Scottish Parents), and a graduate of its University in Civil Engineering In 1925, he came to Canada in 1929 and was proud of his Canadian citizenship. Appointed to the order of Canada in 1 967, when it was established, he was promoted to the Rank of Companion in 1989. A professional Civil Engineer and Geologist; he was also a Historian and author (Rideau Waterway being one of his best known books). He worked on construction projects In Scotland and Canada for eleven years and then taught Civil Engineering at Queen's University and the University of Toronto for another eleven years. He was then called to Ottawa to start in 1947, the Division of Building Research of the National Research Council of which he was director until 1969, when he retired. He received many honours, culminating in his election In 1 987 as the founding president of the Canadian Academy of Engineering, but his continuing joy was in his family and friends.
