Meanwhile, the premier of West-em Australia, Richard Court, fears that up to 80 per cent of his state could be claimed by aborigines, especially as Keating named a Western Australia judge with pro-aborigine credentials to head the claims commission. And Ian McLachlan, opposition spokesman on national development, labelled the new Native Title, Act an "unprecedented act of national masochism." But if elements of white Australia have gone into shock, aborigine organizations don't appear to believe the Mabo case hands them an obvious lever to redress centuries of oppression. "The thing about Mabo is that it has very little affect on the vast majority of aboriginal people because the whole concept of the court's ruling was that native title only applies to people who can show uninterrupted occupation of land and that they still live in a traditional way," Paul Behrendt, director of the Aboriginal Research and Resources Centre at the University of New South Wales, said in an interview. "Most aboriginal people have been forcibly removed from their land and more aborigines live in the suburbs of Sydney and Melbourne than anywhere." This point has been taken up by the Aboriginal and Torres Strait Islander Commission, a body through which the federal government channels most of its Sl-bil-lion-a-ycar assistance to aborigines. "We fail to comprehend how a land fund directed to the dispossessed can fail to cater for the needs of non-traditional, urban aboriginal and Torres Strait Islander people," she said. Warning ihat the commission will oppose any land fund administration which divides "status and non-status indigenous Australians," she urged the government to expand the fund to finance urban housing, community centres and other social facilities for aboriginal people. Launching legal challenges Others are even more adamant that the Mabo case and the land-claims tribunal are a snare for aboriginal people. "What the Mabo case and the land-claims court are about is validation of European land ownership, not about native title," said Paul Coe, head of Aboriginal Legal Services, at his central Sydney office, Coe's organization is launching 1 3 legal challenges to the Mabo decision on the grounds that it is too narrow and still gives government the right to take their land if compensation is paid. "We are a captive, powerless people," he said. "We are totally dependent on welfare because they have taken our land and didn't give us the resources to live our lives. The feeling of powcrlessness in the face of the dominant culture is totally frustrating." i Australia debates aborigine ruling Judgment might take 300,000 out of political limbo JONATHAN MANTHORPE S0UTHAM NEWS IN MEMORIAM MORTIMER MARCUS VINEBERG In loving of a dear husband, father, grandfather and best friend who fassed away April 20, 1991. our love of family formed the heart of an unusual ability to separate the important from impermanent and was the source of a generous and unequalled integrity. We know you are watching over us, guiding and delivering us a little further up the hill. You, with your special strength and perseverance so bravely climbed without thought of surrender or retreat. In darkness as In light we stand together as the bonds forged between us are infinite and eternal. The results of which you and mom so lovingly created. Your presence is always near, illuminating new spaces within our hearts and providing sustenance for the unknown journey ahead. Your spirit lives unconquered and your memory deeply touches all who love you. Sadly missed and always loved and remembered by wife Sally, sister Anne, daughters June, Adele and Hanna, sons David, Ari, Elliot and Jeffrey, grandchildren Allysha, Alana, Maddle, Rebecca and Arielle. Rest in peace Shalom. SYDNEY, Australia More than 300 years after Europeans discovered Australia, the country's High Court has ruled that there were people here before the white explorers arrived. The landmark judgment has given the 300,000 Australian aborigines a legal footing that might begin to take them out of the cultural, political and social limbo in which they have lived since the explorers decided the island continent was "terra uninhabited land containing only people whose culture they did not understand and, therefore, chose to ignore. Receives soma plaudits But although Prime Minister Paul Keating has received some plaudits for beginning to redress the persecution of aborigines through federal legislation and the establishment of a claims tribunal, there is no broad consensus that he has opened the door to change. On the other hand, the case in which the federal High Court decided that Eddie Mubo had native title to land on the Murray Islands in the Torres Strait off Australia's north coast has unleashed a blunt reaction from white Australians, especially in the mining and cattle industries, who wonder how far aboriginal claims to land or compensation will go. "We just have an incredible legal morass that's going to cost a lot of jobs and a lot of investment and do very little to advance aboriginal interests," federal opposkion spokes- OBITUARY ROBERT LEGGET, C.C.
